1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the MovidaOps application, websites, and related services (the “Service”), provided by New Growth Investments LLC (“MovidaOps,” “we,” “us”). By creating a workspace, signing in, or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business.

2. Accounts & workspaces

You are responsible for the accuracy of the information you enter, for maintaining the security of your company code and credentials, and for all activity under your workspace.
You must be at least 18 years old and legally able to enter into a contract.
You are responsible for ensuring your use of scheduling, time-tracking, tip, and payroll features complies with all applicable wage-and-hour, labor, and tax laws in your jurisdiction.

3. Free trial & billing

New workspaces may start with a 30-day free trial. Unless you cancel before the trial ends, the applicable plan fee becomes due.
Plans are priced by team size and billed in advance. Fees are stated on our pricing page and are non-refundable except where required by law.
You may cancel at any time; cancellation stops future billing but does not refund amounts already paid for the current term.

4. Acceptable use

You agree not to misuse the Service, including by attempting to breach security, reverse-engineer the software, upload unlawful content, or use the Service to violate the rights of your employees or any third party. GPS and location features must be used only for legitimate, disclosed timekeeping purposes and in compliance with applicable law and any required employee notice or consent.

5. Your data

You retain ownership of the data you and your team enter (“Customer Data”). You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy.

6. Availability & changes

We work to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features, and may update these Terms; material changes will be communicated through the Service or by email.

7. Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind to the maximum extent permitted by law. MovidaOps is a workforce-operations tool and is not a payroll processor, accountant, or legal advisor; you are responsible for verifying hours, pay, tax, and compliance figures. To the extent permitted by law, our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim. 8. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination you may export your Customer Data for a reasonable period, after which it may be deleted.

9. Governing law
